Verantwortlichkeit in komplexen Daten-Ökosystemen

When using apps or visiting websites, more and more actors are involved in processing personal data for a variety of purposes. Often, they are not visible to data subjects and their actions are hardly controllable. At the same time, powerful platforms usually provide the infrastructure for processing. This development puts the adequacy of private data protection law and its attribution of responsibility to the test. In this area of tension, Florian Wittner uses interdisciplinary findings to highlight the most important actor roles and their spheres of control and influence and to compare them with the responsibility concept of the GDPR, taking into account the ECJ decisions Wirtschaftsakademie and Fashion ID. In this way, deficits are identified and proposals are made for a further development of the regulatory concept of the GDPR on the basis of a new type of platform responsibility under data protection law.
